Terms of Service

1. Provider and Scope
These Terms of Service ("Terms") govern the use of the Mealisto application and associated website (collectively the "Service"). The Service is operated by Mealisto ("we," "us," "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Mealisto under Swiss law.

2. Description of Service
Mealisto is a meal planning application offering: recipe management and discovery, AI-assisted weekly meal planning, family-shared shopping lists, dietary and allergy filtering, nutritional information, and related features on iOS and Android.
We reserve the right to extend, modify, or discontinue features at any time. Where material changes are made, we will notify registered users by email or in-app notification with at least 30 days' notice where practicable.
3. Account Registration
To access the full Service you must create an account. You agree to provide accurate, complete, and current information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Accounts are personal and non-transferable. You must be at least 16 years old to create an account. If you register on behalf of a family group, you represent that you have authority to bind all members to these Terms.
We reserve the right to suspend or terminate accounts that violate these Terms, are found to contain false information, or have been inactive for more than 24 months following advance notice.
4. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the app on devices you own or control, solely for personal, non-commercial household meal planning.
This licence does not include the right to: sublicence, sell, or commercialise the Service; reverse-engineer or decompile the app; use automated means (bots, scrapers) to access the Service; or use the Service to build a competing product.
5. User Content
You retain ownership of recipes, meal plans, notes, and other content you create ("User Content"). By submitting User Content, you grant Mealisto a worldwide, royalty-free, non-exclusive licence to store, display, and process it solely to provide and improve the Service, and to share it within your family group.
You warrant that your User Content does not infringe any third-party intellectual property rights, does not violate applicable law, and is not defamatory, harmful, or misleading.
We may use aggregated, anonymised usage data (not linked to you personally) to improve recipe recommendations and Service quality.
6. Prohibited Conduct
You must not:
• Share, sell, or allow third-party access to your account credentials.
• Harvest, scrape, or systematically download data from the Service.
• Transmit viruses, malware, or any harmful code.
• Use the Service for commercial purposes (e.g. catering businesses, recipe resale) without our prior written consent.
• Circumvent, disable, or interfere with security features.
• Violate any applicable laws or regulations.
7. Subscription Plans and Payment
Mealisto offers the following plans:
— Free plan: Access to core features at no charge, indefinitely.
— Pro subscription: Unlocks advanced planning, unlimited meal plans, and priority features. Pricing is displayed in-app and varies by region. Subscriptions are billed monthly or annually.
All payments are processed exclusively through Apple App Store or Google Play. We do not store payment instrument details. Prices may be adjusted with 30 days' advance notice.
Pro subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your app store account settings.
Refund requests are governed by the applicable app store policy (Apple App Store or Google Play). Swiss consumer law may grant additional rights; please contact support@mealisto.com in case of a dispute.
8. Right of Withdrawal
If you are a consumer resident in the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving a reason, unless you have expressly requested immediate access to the digital content and acknowledged that the withdrawal right is thereby waived.
For Swiss residents, the provisions of the Swiss Code of Obligations (Art. 40a–40f OR) on distance contracts apply where applicable.

9. Availability and Service Changes
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, technical failures, or force majeure events may cause temporary outages.
We reserve the right to modify, suspend, or discontinue any part of the Service. For significant feature removals affecting paid subscribers, we will provide reasonable advance notice and, where appropriate, a pro-rata refund for unused prepaid periods.
10. Intellectual Property
All elements of the Service not constituting User Content — including software, design, text, graphics, logos, and curated recipes — are owned by or licensed to Mealisto and are protected by Swiss and international intellectual property law.
You may not copy, reproduce, distribute, or create derivative works from our Content without our express prior written consent.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nutritional information and recipe content are provided for informational purposes only. We do not guarantee accuracy and recommend consulting a qualified dietitian or physician for medical dietary advice.
12. Limitation of Liability
To the maximum extent permitted by Swiss law (Art. 100 OR), Mealisto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or loss of profits, arising from your use of or inability to use the Service.
Our aggregate liability for direct damages is limited to the total fees paid by you to Mealisto in the 12 months preceding the event giving rise to the claim, or CHF 50 if no fees were paid.
Nothing in these Terms excludes or limits liability for gross negligence, intentional misconduct, or death and personal injury caused by Mealisto's fault, as these cannot be excluded under Swiss law.
13. Data Protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. We process personal data in accordance with the Swiss Federal Act on Data Protection (nFADP / DSG, as revised September 2023) and, where applicable, the EU General Data Protection Regulation (GDPR).
You have the right to access, correct, and delete your personal data. Requests may be submitted to support@mealisto.com.
14. Indemnification
You agree to indemnify and hold harmless Mealisto and its affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in breach of these Terms; (b) your User Content; or (c) your violation of any applicable law or third-party right.
15. Third-Party Services
The Service may contain links to or integrations with third-party services (e.g. Apple App Store, Google Play). We are not responsible for the content, privacy practices, or availability of such third-party services. Your use of them is subject to their own terms.
16. Amendments to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and may delete your account before the effective date.
17. Governing Law and Jurisdiction
These Terms are exclusively governed by the substantive law of Switzerland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Zurich, Switzerland.
Mandatory consumer protection provisions of your country of residence (if within the EU/EEA) remain unaffected by the choice of law and jurisdiction above.
18. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the intended economic purpose.
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Mealisto regarding the Service.
